Hunting for hidden assets during your divorce

It is no secret that a Texas divorce is complicated. From child custody to dividing stuff between two contentious parties, it can be quite difficult to navigate this process. In a divorce involving complex, valuable or potentially hidden assets, these difficulties increase exponentially. If you are facing a financially complex divorce, you do not have to face it alone.

In some high asset divorces, a spouse may face the temptation to hide or misrepresent the true value of an asset. This is completely unfair to the other spouse, who may have a rightful claim to a portion of that asset. If you believe that your soon-to-be ex-spouse is hiding assets to keep you away from your fair share of marital property, you should take quick action to protect your rights.

Finding assets that are not easily seen

It can be frustrating, even infuriating, to learn that your spouse is hiding assets. Whether you have definitive proof or simply suspect that something isn't quite right with the initial voluntary disclosure of marital property, there are definitive steps that you can take to protect yourself and your financial interests. Some of the things that you can do include:

  • Carefully go over the voluntary disclosure. Both parties will typically submit disclosures, which are essentially lists of personal property. This is the foundation of a fair property division settlement, and a careful review can determine if your spouse left something off intentionally.
  • Demand further disclosures. If you are not satisfied with the results of the first disclosure, you can take steps to demand involuntary disclosures. When requested formally, your spouse must comply and answer questions within a certain amount of time.
  • Seek answers through a deposition. It is possible that you will have the opportunity to seek answers from your spouse through a deposition. This is a sworn testimony, and anything said during this can be used in court at a later date.

With a thorough investigation, experienced guidance and perhaps the help of a forensic accountant, it is possible to find out where all marital properties are and how you can get your fair share of all of it.

Don't give up on your future

The fight for a fair property settlement can be long and stressful. You may feel like giving up at times, but you do not have to face this battle alone. Through the appropriate steps, you can find out if your spouse is hiding assets and determine how you can pursue a strong post-divorce future.
